Terms of Service

By inviting Vesper to your Discord server, accessing our dashboard, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use Vesper.

These Terms constitute a legally binding agreement between you ("User," "Server Owner," or "you") and the Vesper team ("Vesper," "we," "us," or "our"). We reserve the right to modify these Terms at any time.

You must meet the following requirements to use Vesper:

• You must be at least 13 years of age, or the minimum age required in your jurisdiction, whichever is greater.
• You must have a valid Discord account in good standing, compliant with Discord's Terms of Service.
• If you are using Vesper on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We do not knowingly collect personal information from individuals under the age of 13. If you become aware that a minor has provided us with personal data, please contact us immediately.

Vesper is provided for the purpose of community moderation, security, and management on the Discord platform. You agree to use Vesper only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use Vesper to harass, abuse, threaten, or discriminate against any individual or group.
• Attempt to reverse-engineer, decompile, or extract the source code of Vesper.
• Use Vesper to violate Discord's Terms of Service or Community Guidelines.
• Exploit, abuse, or misuse Vesper's systems in ways that could degrade service for others.
• Circumvent, disable, or interfere with security-related features of Vesper.
• Resell, sublicense, or commercially exploit access to Vesper without express written permission.

Vesper collects and processes certain data in order to provide its services. This includes server configuration settings, moderation logs, and aggregated usage metrics. All data is encrypted at rest and in transit.

• Server-scoped data is accessible only to server administrators with appropriate permissions.
• You may request deletion of all data associated with your server at any time via the dashboard.
• We do not sell personal data to third parties.
• Message content is processed transiently for moderation purposes and is not persistently stored unless explicitly configured for audit logging by the server owner.

Vesper is provided on an "as is" and "as available" basis. While we strive for high availability, we do not guarantee uninterrupted or error-free service. Scheduled and unscheduled maintenance windows may affect availability.

We reserve the right to modify, suspend, or discontinue any part of Vesper at any time, with or without notice, and without liability to you.

To the maximum extent permitted by applicable law, Vesper and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, revenue, or profits resulting from use or inability to use Vesper.
• Unauthorized access to or alteration of your server configurations or data.
• Actions taken by Vesper's automated moderation systems, including erroneous bans or mutes.
• Any content posted or transmitted by users of your server.

You agree to indemnify and hold harmless Vesper and its operators from any claims, losses, or damages arising from your use of the service or violation of these Terms.

Either party may terminate this agreement at any time. You may terminate by removing Vesper from your Discord server and ceasing to use our services. We may terminate or suspend your access immediately, without prior notice, for:

• Breach of these Terms of Service.
• Actions that we determine, in our sole discretion, are harmful to other users, third parties, or the reputation of Vesper.
• Requests by law enforcement or government agencies.
• Unexpected technical or security issues.

Upon termination, your right to use the service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property provisions and limitations of liability.

These Terms are governed by applicable law. Any disputes arising from these Terms or your use of Vesper shall be resolved through good-faith negotiation before pursuing formal legal action.
